Bois D’Arc man allegedly attempted to mace, bite security guard at gas station
A Bois D’Arc resident was taken into custody on Wednesday, July 10, after he failed to appear for a court hearing regarding charges he is facing. Bobby Apodaca, 49, is charged with third degree assault and possession of a controlled substance.
The assault charge
According to the probable cause statement regarding the assault charge, Apodaca allegedly attacked a security guard at a convenience store in Springfield on Dec. 10, 2023. The probable cause statement reported that a police officer was called to the Fast and Friendly convenience store on Scenic, where he found a Task-9 security officer holding Apodaca on the ground. The security officer told the policeman that while interacting with Apodaca, Apodaca produced some pepper spray and deployed it at him (the security officer). The security officer said that he was able to get the pepper spray out of Apodaca’s possession and throw it away from him while detaining Apodaca. He also said it was the second call he’d had regarding Apodaca at the convenience store.
A witness to the incident told the police officer that Apodaca went into the convenience store with a stick and began swinging it around while demanding that the clerk call the police.
After he knocked some items off the counter, the witness said, the security officer arrived and began speaking to Apodaca. The witness reported that Apodaca tried to hit the security officer with the stick but was unsuccessful, so he “maced” the security guard. Additionally, the witness said, Apodaca tried to bite the security officer on the officer’s hands and forearms as they were wrestling, but was unsuccessful.
Apodaca refused to identify himself to law enforcement, according to the probable cause statement, but a witness was able to give officers his name.
Possession charge
According to the probable cause statement regarding the possession charge, a Springfield police officer found Apodaca on Aug. 19, 2023; Apodaca was allegedly in possession of a glass bubble pipe, a sunglasses case containing numerous baggies with a crystalline substance in them, and a lighter. The officer took Apodaca into custody and submitted the baggies as evidence. The officer reported that the baggies were tested by the Missouri State Highway Patrol laboratory, which determined that the crystalline substance in the bags was methamphetamine.
Failure to appear
Apodaca was issued a criminal summons to appear in court on July 2 for both the assault and possession charges. According to online court records, he failed to appear, and an arrest warrant was issued for him. He was taken into custody on July 10 and booked into the Greene County Jail. Online court records show he was released on his own recognizance on Monday, July 22.
Apodaca was a Springfield resident when he was originally charged with assault and possession, but according to online records, a change of address showing him as living in Bois D’Arc was filed on June 17.
